TRUST & PROBATE LITIGATION OR DEATH LITIGATION
Families should get closer on the death of a loved one, but many times the death of a family member (namely a parent) brings on controversy or dispute rising to the level of litigation.
Disputes are especially prevalent when:
- A deceased parent has children trom different marriages;
- Fiduciary (Executor-Trustee) child fails to give accurate records or any records or accounting to the other children or family members;
- Remarriage of a parent and the new spouse controls the assets as Executor or Trustee of the deceased person's estate or there is commingling of assets;
- When one child believes he or she is more equal or deserves more than another and acts upon those beliefs by securing a larger share of the assets from the family members prior to their death;
- Trustee and/or Executor misconduct and/or removal for their improper acts including improper investment;
- Creditors and the IRS problems are what this office entitles normal litigation but these disputes can be avoided with planning and communication unlike family disputes which require different techniques to resolve.
